Abstract

Portuguese Abstract: A reivindicação crescente de direitos sociais relançou para a arena a controvérsia sobre se será economicamente sustentável e politicamente admissível uma intervenção tão estreita do Estado na sociedade. Atualmente, em vários Estados da Europa Ocidental atingidos pela crise financeira internacional, assiste-se a uma estagnação na força expansiva dos direitos sociais e não faltam vozes que alertam para os elevados custos sociais de um eventual retrocesso político-legislativo nesta matéria.

Em maio de 2011, a situação das finanças públicas portuguesas impeliu o Estado a aceitar um “programa de assistência económica e financeira”, que se corporizou no Memorando de Entendimento acordado com a tríade Comissão Europeia, Banco Central Europeu e Fundo Monetário Internacional (conhecida por Troika) e que implicou a adoção de fortes medidas de austeridade, mormente cortes na despesa pública e o aumento de impostos. Nesta conjuntura, não é de surpreender que tenham reacendido os seguintes debates constitucionais: (i) até que ponto (ou se é de todo admissível) um retrocesso ou uma reformatio in pejus dos direitos a prestações derivados da lei; (ii) qual o papel do Tribunal Constitucional perante as polémicas medidas anticrise.

Todo este ambiente de incerteza convida, pois, a que tomemos posição quanto à proliferação legislativa que diminui, em maior ou menor medida, prestações sociais tidas por fundamentais para o bem-estar social, em domínios como os da previdência, dos salários, da segurança ou da saúde. Torna-se, por conseguinte, necessária uma “caraterização concetual” dos direitos sociais. Estamos, sem dúvida, perante uma matéria complexa, na fronteira do político e do mundividencial, e que assenta em pilares movediços, não se compaginando com argumentos extremistas, porquanto a quase totalidade deles acabam por ser reversíveis.

English Abstract: The growing demand for social rights has re-launched into the arena the controversy over whether it will be economically sustainable and politically admissible a narrow intervention of the state in the society. In several Western European states affected by the international financial crisis there is a stagnation in the expansion of social rights and there is no shortage of voices warning of the high social costs of a possible political and legislative retrogression in this area.

In May 2011, the situation of the Portuguese finances prompted the State to accept a “Program of Economic and Financial Assistance”, which was embodied in the Memorandum of Understanding agreed with the triad of the European Commission, European Central Bank and International Monetary Fund (Troika), and which implied the adoption of strong austerity measures, mainly cuts in public spending and tax increases. In this scenario, it is not surprising that the following constitutional debates have rekindled : (i) to what extent (or if it's at all admissible) a retrocession or reformatio in pejus of social rights; (Ii) what is the role of the Constitutional Court in face of the controversial anti-crisis measures.

This whole environment of uncertainty therefore invites us to take a position on the proliferation of legislation that downsizes, to a greater or lesser extent, social benefits considered fundamental to social welfare, in areas such as pensions, wages, work safety or health. A “conceptual characterization” of social rights is therefore necessary. We are undoubtedly faced with a complex matter, at the border of the political and based on unstable pillars, which does not combine with extremist arguments, since almost all of them turn out to be reversible.
