Abstract

French Abstract: L’auteur argumente que la décision de la Commission de restructuration des services de santé de transformer l’Hôpital Montfort en clinique ambulatoires constitue de discrimination qui viole l’article 15 de la Charte canadienne des droits et libertés. Il démontre que la décision crée une distinction discriminatoire puisqu’elle retire de la communauté francophone de l’Ontario l’accès aux services médicaux et à une éducation médicale en français, un désavantage qu’elle n’impose pas aux anglophones. Il explique aussi que la communauté francophone constitue un groupe analogue à ceux énumérés à l’article 15 puisqu’elle forme une minorité discrète, isolée et vulnérable qui a été victime de désavantages historiques. Finalement, il explique que le recours approprié pour rectifier l’acte discriminatoire du gouvernement ontarien est le maintien d’un hôpital francophone autonome.

English Abstract: The Author argues that the decision of the Health Care Restructuring Commission to transform the Montfort hospital into a walk-in clinic constitutes discrimination and violates Article 15 of the Canadian Charter of Rights and Freedoms. The author shows that the decision creates a discriminatory distinction since it denies access to healthcare services and medical education to the Francophone community, a disadvantage which it does not impose on Anglophones. He also explains that the Francophone community constitutes a group analogous to those enumerated in Article 15 as they form a discrete, isolated and vulnerable minority that has been the victim of historical disadvantages. Finally, the author explains that the proper course of action needed to rectify the Government of Ontario's discriminatory action is to ensure the maintenance of an autonomous Francophone hospital.
